1. Acceptance of Terms

By accessing or using Equizzle ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Platform. These terms apply to all visitors, users, and others who access or use the service.

2. Description of Service

Equizzle provides an online assessment and test preparation platform for standardized exams including K-12 Math & Science, SAT, ACT, AP, IELTS, and TOEFL. The Platform includes adaptive assessments, AI-powered analysis, leaderboards, certificates, and study resources.

3. User Accounts

To use certain features of the Platform, you must create an account via Google or Apple sign-in. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Providing accurate and complete profile information
• Notifying us immediately of any unauthorized use of your account

4. Purchases & Payments

The Platform offers both free diagnostic assessments and paid full assessments. All payments are processed securely through Stripe. By making a purchase, you agree that:

• All fees are stated in USD unless otherwise indicated
• Purchases grant you access to specific assessments with a limited number of attempts
• Coupon codes are subject to their individual terms and expiration dates
• Refunds are handled in accordance with our Refund Policy

5. Assessment Integrity

During assessments, you agree to:

• Complete all assessments independently without external assistance
• Not share, distribute, or reproduce assessment questions
• Not use unauthorized tools, software, or browser extensions during tests
• Accept that security monitoring may be in place during assessments

Violation of assessment integrity rules may result in score invalidation and account suspension.

6. Intellectual Property

All content on the Platform — including questions, assessments, analysis tools, blog posts, and branding — is the property of Equizzle Inc. and is protected by intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without prior written permission.

7. User Content

By submitting content to the Platform (such as support tickets, profile information, or testimonials), you grant Equizzle a non-exclusive, royalty-free license to use, display, and distribute such content in connection with the Platform's operation and promotion.

8. Leaderboard & Certificates

Scores published on the leaderboard and certificates are based on verified assessment results. Equizzle reserves the right to remove scores or revoke certificates if assessment integrity violations are detected.

9. Disclaimer of Warranties

The Platform is provided "as is" and "as available" without warranties of any kind. Equizzle does not guarantee that the Platform will be uninterrupted, error-free, or secure. Assessment scores are for educational and self-assessment purposes and do not guarantee performance on actual standardized exams.

10. Limitation of Liability

To the fullest extent permitted by law, Equizzle Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Our total liability shall not exceed the amount you paid to Equizzle in the 12 months preceding the claim.

11. Termination

We may terminate or suspend your account at any time for violation of these terms or for any other reason at our discretion. Upon termination, your right to use the Platform ceases immediately.

12. Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify users of material changes via email or a notice on the Platform. Continued use of the Platform after changes constitutes acceptance of the updated terms.

13. Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
